1. Agreement to terms

These Terms & Conditions (“Terms”) govern your access to and use of the PropertyScan platform, websites, and related services (the “Service”) provided by KMI (“we”, “us”, or “our”). By creating an account, starting a free trial, or otherwise using the Service, you agree to be bound by these Terms.

If you are using the Service on behalf of a company or organization, you represent that you have authority to bind that entity to these Terms.

2. Definitions

“Account” means a registered profile used to access the Service. “Owner” refers to developers and builders who own inventory. “Realtor” refers to agents and brokerages representing buyers and listings. “Lead” means buyer contact and engagement data captured through the Service.

3. Accounts and eligibility

You must provide accurate, complete information when creating an Account and keep it up to date. You are responsible for safeguarding your login credentials and for all activity under your Account.

You must be at least 18 years old and capable of forming a binding contract to use the Service.

4. Free trial, plans, and billing

PropertyScan offers a 7-day free trial. No credit card is required to start, and we will notify you by email and SMS before the trial ends. Paid plans are billed monthly or annually depending on the plan you select. Annual plans may be offered at a discount.

Add-ons are billed in addition to your plan and may be added or removed at any time in Billing. Fees are non-refundable except where required by law. You may upgrade, downgrade, or cancel your plan at any time; changes take effect according to your billing cycle.

5. Acceptable use

You agree not to misuse the Service, including by attempting to access it through unauthorized means, interfering with its operation, uploading unlawful content, or using captured Lead data in violation of applicable privacy, marketing, or anti-spam laws.

You are responsible for obtaining any consents required to contact buyers and for complying with all laws applicable to your communications, including SMS and email regulations.

6. Data and privacy

You retain ownership of the data you submit and the Leads you capture. You grant us a limited license to process this data to provide and improve the Service. We implement reasonable safeguards to protect data, but no system is completely secure.

Our handling of personal information is described in our Privacy Policy, which forms part of these Terms.

7. Third-party integrations

The Service may integrate with third-party tools such as CRMs, analytics, and email-marketing platforms. Your use of those tools is governed by their own terms, and we are not responsible for third-party services.

8. Intellectual property

The Service, including its software, design, and content, is owned by KMI and protected by intellectual-property laws. These Terms do not grant you any rights to our trademarks or branding except as needed to use the Service.

9. Termination

You may stop using the Service at any time. We may suspend or terminate access if you breach these Terms or use the Service in a way that risks harm to others. Upon termination, your right to use the Service ceases; certain provisions survive termination by their nature.

10. Disclaimers and limitation of liability

The Service is provided “as is” without warranties of any kind. To the maximum extent permitted by law, KMI is not liable for indirect, incidental, or consequential damages, or for lost profits or data, arising from your use of the Service.

11. Changes to these terms

We may update these Terms from time to time. If we make material changes, we will provide notice through the Service or by email. Continued use after changes take effect constitutes acceptance of the updated Terms.
